2. Scope and acceptance
These Terms apply to purchases made through TRAFICAPTURE™ sales and payment pages and to the use of the corresponding digital content, courses, resources and access areas.
Before payment, the customer is shown the essential characteristics of the selected offer, its total price, the applicable access conditions and the payment obligation.
The customer must have the legal capacity to enter into a contract. A customer purchasing on behalf of a business confirms that they are authorised to bind that business.
3. Product and offer
Foundation Entry
Foundation Entry is a digital implementation product within the TRAFICAPTURE™ Foundation level. It provides access to the Foundation Core and its associated educational and strategic resources.
- One-time purchase price: €39, tax included.
- No recurring subscription.
- Immediate digital access after successful payment.
- Access to the Foundation Core as presented on the payment page at the time of purchase.
Any future TRAFICAPTURE™ products, including Builder or Commit, are separate offers unless a payment page expressly states otherwise.
4. Ordering and contract formation
The customer selects the offer, supplies the information necessary to process the purchase, chooses an available payment method and confirms the order using the payment button.
The contract is formed when payment is successfully authorised and the customer receives an order or access confirmation. The seller may refuse or cancel an order where payment fails, fraud is reasonably suspected, the information supplied is materially incorrect, or the transaction cannot lawfully be completed.
An electronic confirmation and the relevant contractual information are supplied to the email address entered during checkout. The customer is responsible for providing a valid email address and checking any spam or filtered-message folder.
5. Price, tax and payment
Prices are displayed in euros. Unless expressly stated otherwise, the displayed consumer price includes the applicable tax.
Payment is due in full when the order is placed. Available payment methods are displayed directly on the secure payment page and may vary by country, device or payment provider.
Payment information is handled by the payment provider selected during checkout. TRAFICAPTURE™ does not receive the customer's complete card credentials.
The customer is responsible for any charges imposed independently by their bank or payment provider, including currency-conversion or cross-border fees.
6. Digital delivery and access
Digital access is normally granted immediately after successful payment and confirmation of the customer's request for immediate performance.
Access requires a valid email address, an internet connection and a reasonably current browser. The customer is responsible for maintaining access to their email account and for keeping any login credentials confidential.
If access is not received within a reasonable period after successful payment, the customer should contact contact@zdp.ai with the email address used for the order.
7. Right of withdrawal and immediate digital access
Consumers ordinarily have a 14-day right of withdrawal for distance contracts, subject to the exceptions and conditions imposed by applicable law.
Where digital content is supplied immediately and is not delivered on a tangible medium, the customer is asked before purchase to:
- expressly request that access begin immediately;
- expressly acknowledge that the right of withdrawal is lost once access begins; and
- accept the applicable contractual terms.
When these legal conditions are satisfied and digital access begins, the customer no longer has the 14-day right of withdrawal for that digital content.
This does not remove any mandatory rights relating to defective, inaccessible or non-conforming digital content. If the required consent, acknowledgement or contractual confirmation has not been validly obtained, the customer's statutory rights remain unaffected.
Withdrawal or statutory-right enquiries may be sent to contact@zdp.ai.
8. Digital-content conformity, support and refunds
TRAFICAPTURE™ will supply the digital content described in the offer and will take reasonable steps to maintain the access necessary to use it. Mandatory legal guarantees concerning digital-content conformity remain fully applicable.
If the product is unavailable, materially different from its description or technically unusable for reasons attributable to the seller, the customer should contact support so that access can be restored, the content brought into conformity, or another remedy supplied where required by law.
After valid immediate-access consent and commencement of digital delivery, a discretionary change-of-mind refund is not guaranteed. Nothing in this provision limits a refund or other remedy required by mandatory consumer law.
9. Licence, account security and permitted use
A purchase grants the customer a personal, limited, non-exclusive and non-transferable right to access and use the purchased digital content for lawful personal or internal business purposes.
The customer may not:
- share, sell, sublicense or transfer their access;
- republish or commercially redistribute the content;
- circumvent access or security controls;
- copy or reproduce substantial parts of the content except where expressly permitted by law; or
- use the product to infringe the rights of another person.
Access may be suspended where there is credible evidence of fraud, unauthorised sharing, abusive conduct or a material breach of these Terms. Where appropriate, the customer will be given a reasonable opportunity to remedy the breach.
10. Intellectual property
TRAFICAPTURE™, the White Heart Framework, the course structure, written content, diagnostic logic, design elements and associated materials are protected by applicable intellectual-property laws.
Purchasing access does not transfer ownership of any trademark, copyright, methodology, software, database or other intellectual property. All rights not expressly granted remain reserved.
11. Availability, maintenance and changes
Reasonable maintenance, security work and technical updates may temporarily affect access. TRAFICAPTURE™ will take reasonable steps to minimise disruption.
Content may be updated to improve accuracy, usability, security or relevance. An update will not intentionally remove the essential benefit of an existing paid purchase without providing an appropriate solution consistent with applicable law.
12. Results, professional decisions and liability
TRAFICAPTURE™ provides strategic and educational information. Business, traffic, lead-generation, conversion or revenue results depend on many factors outside the seller's control and are not guaranteed.
The customer remains responsible for implementation choices, business decisions and compliance with laws applicable to their own activity. The content is not individual legal, accounting, tax, investment or financial advice.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, intentional misconduct, gross negligence or mandatory consumer rights.
13. Personal data and communications
Personal data necessary to administer the order, process payment, provide access, issue transactional communications and handle support is processed for those purposes.
TRAFICAPTURE™ follows the White Heart Framework principle of requesting only information reasonably necessary for the stated transaction and service.
Transactional emails relating to an order or purchased access are distinct from optional promotional communications. Where consent is legally required for marketing, it will be requested separately.
Questions about personal data may be sent to contact@zdp.ai.
14. Applicable law and dispute resolution
These Terms are governed by Belgian law, without depriving a consumer residing in another country of any mandatory protection granted by the law applicable to that consumer.
Before starting formal proceedings, the customer is invited to contact contact@zdp.ai so that an amicable solution can be attempted.
If no amicable solution is found, jurisdiction will be determined under the mandatory rules applicable to the transaction. Nothing in these Terms restricts a consumer's right to use an available official consumer-dispute mechanism.
15. Changes to these Terms
These Terms may be updated for future purchases to reflect legal, operational or product changes. The version accepted at the time an order is placed governs that purchase.
A later update will not retrospectively remove rights already acquired by an existing customer unless the change is legally required and implemented in accordance with applicable law.
